Terms and Conditions

These Terms and Conditions ("Terms") govern your use of yatsum.com.hk (the "Site") and any purchase you make from Yat Sum System Technology Limited ("we", "us", "our"). By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.

1. Definitions

"Customer" or "you" means the person using the Site or placing an order. "Products" means goods offered for sale on the Site. "Order" means your request to purchase Products.

2. Eligibility and Account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your account credentials confidential and for all activity under your account.

3. Products and Availability

Product descriptions, images and specifications are provided in good faith and may be updated by manufacturers without notice. All Products are subject to availability; we may limit quantities or withdraw Products at any time without liability.

4. Prices and Errors

Prices are shown in Hong Kong Dollars (HKD) unless stated otherwise, and exclude delivery charges unless stated. Despite our efforts, prices or information may occasionally be incorrect. We reserve the right to correct errors and to cancel an Order (with a full refund) where a pricing or product error is discovered, even after an Order confirmation.

5. Orders and Acceptance

Your Order is an offer to buy. A contract is formed only when we accept your Order (for example by dispatching the Products or sending an acceptance). We may decline or cancel an Order where a Product is unavailable, payment is not confirmed, the Order appears fraudulent, or where required by law.

6. Payment

We accept the payment methods shown at checkout, which may include bank transfer / FPS, cheque and cash on delivery. For bank transfer / FPS and cheque, an Order is processed only after payment is received and cleared. We are not responsible for delays caused by your bank or payment provider.

7. Delivery

We deliver within Hong Kong unless otherwise agreed. Delivery times are estimates and not guaranteed. Risk in the Products passes to you on delivery. Where delivery fails due to an incorrect address or non-collection, additional charges may apply.

8. Returns, Exchanges and Refunds

Returns, exchanges and refunds are subject to our returns policy and to applicable law. Please contact us within a reasonable time of receipt. Products must be returned unused and in their original packaging with proof of purchase. This clause does not affect any non-excludable statutory rights.

9. Warranty and Disclaimers

Products may carry the manufacturer's warranty. Except as expressly stated, and to the fullest extent permitted by law, the Site and Products are provided without additional warranties. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Hong Kong (including the Control of Exemption Clauses Ordinance (Cap. 71) and the Sale of Goods Ordinance (Cap. 26)).

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for loss of profit, data or goodwill. Our total liability in respect of any Order is limited to the amount you paid for that Order. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold us harmless against claims, losses and costs arising from your breach of these Terms or misuse of the Site.

12. Intellectual Property

All content on the Site (text, images, logos and marks) is owned by us or our licensors and may not be used without our permission.

13. Third-Party Links

The Site may contain links to third-party sites. We are not responsible for their content, products or practices.

14. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control.

15. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of your Order applies to that Order.

16. General

If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver. These Terms are the entire agreement between us regarding the Site. You may not assign your rights without our consent.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China. You and we submit to the exclusive jurisdiction of the courts of Hong Kong.
